Legal Services Commissioner’s approach to systemic issues in the legal profession

The Legal Services Commissioner (LSC) is committed to driving systemic change and continual improvement in the delivery of legal services in Victoria. The LSC has developed an organisational focus on systemic industry problems, and aims to identify potential issues as early as possible from complaints received.

Systemic issues are dealt with in a variety of ways including:

• Seeking specific orders aimed at resolving the systemic problem, where the systemic issue amounts to a disciplinary breach that is considered by VCAT.
• Providing suggestions, in the course of considering complaints, for improvements to practices, policies, systems or conduct;
• Addressing widespread systemic problems in the LSC’s educational activities with the profession. A recent example is the Family Law Round Table; and
• Referring information about systemic issues to the Legal Services Board where the information relates to a function of the Board.
