Costs disputes in family law matters

July 2008

Recent amendments to the Family Law Rules 2004 have changed the way costs disputes in family law matters are handled.

The amendments, which took effect on 1 July 2008, gave the Legal Services Commissioner jurisdiction to deal with costs disputes in family law matters where proceedings have been issued in the Family Court of Australia or the Magistrates' Court of Victoria.

Human Rights Training

December 2007

Staff of the Legal Services Commissioner were provided with training on human rights and the specific obligations imposed on public authorities by the new Charter of Human Rights and Responsibilities Act 2006 (Vic). The key provisions relevant to public authorities come into operation on 1 January 2008.

Fact Sheets on Challenging Legal Costs

October 2007

The Legal Services Commissioner has developed Fact Sheets about how to challenge legal costs and the rights of clients with respect to costs.

The Fact Sheets have been developed in consultation with the Law Institute of Victoria Ltd and the Victorian Bar Inc. They have been made under the new Legal Profession (Further Amendment) Regulations 2007.
